This page explains the rules for using ortho-athlete.com and what you can expect from us.

Acceptance

These Terms of Use (the "Terms") govern your use of ortho-athlete.com (the "Site"). Ortho Marketing, LLC ("we," "us," or "our") operates the Site. By using the Site, you agree to the Terms. If you do not agree, please do not use the Site.

Our Privacy Policy also applies to your use of the Site. The Terms apply to the Site only. They do not govern the Injured app. The app has its own privacy policy, available in the app and on its App Store and Google Play listings.

Educational Content and No Medical Advice

The content on the Site is educational. It describes injuries, recovery, and the process athletes follow through the Injured app and at the OrthoAthlete facility. It is not medical advice.

Do not rely on the Site to diagnose or treat any condition. Consult a licensed provider about your own situation. Athlete stories on the Site reflect individual experiences. They are not a promise of any result.

Intellectual Property

Unless noted below, the Site and its content belong to Ortho Marketing, LLC or its licensors. That includes text, images, videos, logos, and the design of the Site. You may view the Site for personal, noncommercial use only. You may not copy, reproduce, distribute, modify, or publicly display Site content without our written permission.

The Site shows the names and logos of leagues and teams. Those marks refer to the affiliations of athletes who have shared their stories. They belong to their respective owners. Their appearance does not mean those organizations endorse the Site, OrthoAthlete, the Injured app, or Ortho Marketing, LLC.

No Warranty

The Site is provided "as is" and "as available." We make no warranties of any kind about the Site or its content, whether express or implied. That includes implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be accurate, complete, error-free, or uninterrupted. Some states do not allow the exclusion of implied warranties, so some of these exclusions may not apply to you.

Limitation of Liability

To the fullest extent the law allows, we are not liable for damages arising from your use of the Site. This protection extends to our owners, employees, and agents. It covers indirect, incidental, special, consequential, and punitive damages, and damages for lost profits or lost data. It applies to any claim based on the Site, its content, or any linked service, however the claim arises. Our total liability for any claim related to the Site will not exceed [Liability cap amount]. Some states do not allow these limits, so some of them may not apply to you.

Governing Law

The laws of the State of Utah govern the Terms and your use of the Site, without regard to conflict-of-law rules. Any dispute related to the Terms or the Site will be heard in the state or federal courts located in Utah.

Changes

We may update the Terms at any time. When we do, we will post the new version on this page and change the effective date at the top. Your continued use of the Site after a change means you accept the updated Terms.
